Is weed legal in Wyoming?

No. Wyoming has not legalized recreational or medical marijuana, therefore it is against the law to use or possess cannabis in the state.

However, hemp-derived cannabidiol (CBD) products that contain less than 0.3% THC by weight are legal to use and possess.

Legislation history

On March 6, 2019, the state enacted HB0171 , which was signed into law by Gov. Mark Gordon. It gave the Department of Agriculture authority over hemp production and regulation.

After the signing of HB0171, the Department of Agriculture submitted its plan for regulating hemp in the state to the US Department of Agriculture. The act formally removed hemp-derived CBD from Wyoming’s list of controlled substances.

There were at least two attempts by advocates to place marijuana legalization on the state ballot, including an effort to get it in front of voters in 2018 . But advocates failed to gather enough signatures to qualify.

Penalties

In Wyoming, the penalties for those caught with marijuana are among the harshest in the United States. Being found under the influence of marijuana is considered a misdemeanor punishable by six months imprisonment and a $750 fine. Growing, drying, or processing cannabis can result in a misdemeanor, six months imprisonment, and a $1,000 fine. Possession of less than 3 ounces (85 grams) can result in a misdemeanor, 12 months imprisonment, and a $1,000 fine. Additionally, possession within 500 feet of a school is punishable by an additional fine of $500.

Cannabis & CBD in Wyoming – Are They Legal?

Welcome to the latest round of legislative meanderings concerning marijuana and CBD! Those familiar with the complexities of these laws are doubtless saying “not again” as they light a joint to relax their frayed nerves. Of course, only residents of 11 states plus Washington, D.C., can do this without an MMJ card. Even in some of those locations, recreational cannabis isn’t yet for sale!

Then there are the other 22 states that have medical marijuana programs. Again, a handful has yet to implement the program in any meaningful way. As for CBD, the rules surrounding it are the stuff of migraine headaches. Like cannabis itself, the compound, CBD, isn’t federally legal. However, hemp that contains CBD, is!

The 2018 Farm Bill led us to the current merry-go-round of confusion, consternation, and condemnation. You see, each state is allowed to make rules regarding cannabidiol. Few of them have provided any clarity whatsoever. We have a truly bizarre situation where marijuana is recreationally legal, but CBD is technically illegal in at least one state (we’re looking at you, California).

With CBD at the whims of state and even local lawmakers, things are getting messy. At Wayofleaf, we continue to delve into the cannabidiol labyrinth, in the hope we don’t run into the minotaur! Today, we take a look at Wyoming and see if cannabis and CBD are legal in that state. At least on this occasion, the rules are somewhat clear!

Does Wyoming Permit Marijuana?

In a nutshell, heck no! Wyoming has among the strictest anti-marijuana stances in the United States. There is disagreement over when the state first banned the plant. In the Pursuit of Oblivion: A Social History of Drugs, Richard Davenport-Hines suggests prohibition occurred in 1929. However, in The SAGE Encyclopedia of Pharmacology and Society, Sarah E Boslaugh writes that the ban happened in 1913.

Either way, Wyoming has remained firmly against cannabis ever since. In 2015, the Wyoming chapter of NORML gained signatures to get MMJ on the 2016 ballot. However, the state’s ballot initiative requirements are among the toughest in the nation. In the state’s House of Representatives, legislation to decriminalize marijuana has failed several times.

This is despite a 2014 poll showing that 72% of the population supported the use of marijuana if approved by a doctor. A survey from 2016 showed that MMJ support had increased to 81%. An even more recent poll put the percentage in favor at 86%! Alas, there was no movement in the state legislature when it adjourned its session in the first half of 2020.

At present, without decriminalization, there are strict penalties in play. Being caught ‘under the influence’ of cannabis is a misdemeanor in Wyoming! It comes with a potential jail term of six months. Possession of less than three ounces is also a misdemeanor but has a possible prison sentence of up to a year. Possession of over three ounces is a felony, and you could spend up to five years in jail. Sale of any amount is a more serious felony, and comes with a maximum sentence of ten years!

According to a 2018 ACLU report, African-Americans in Wyoming are 5.2 times more likely to get arrested for marijuana possession. This is despite a similar rate of usage.

What Is the Situation with CBD in Wyoming?

It is better news on the CBD front, though even that is only a recent development. For a very long time, the state of Wyoming resisted any attempts to legalize CBD for any reason. That changed in 2015 when a law took effect and allowed the use of CBD oil to treat seizures. At that point, you were not legally permitted to use it for any other reason. It was an incredibly narrow law with no in-state access.

At the time, you could only apply through the Wyoming Department of Health (WDH). You could use medical CBD after a doctor prescribed it to treat seizures caused by epilepsy. You needed to apply for a Hemp Extract Registration Card. It cost $150 and required annual renewal, just like MMJ cards in other states.

Even those with intractable epilepsy could only use CBD oil with a maximum THC content of 0.3%. It was also necessary to register with the Hemp Extract Registry!

Common Sense Prevails in Wyoming

The above was an awful lot of trouble to go to just to use CBD oil! After years of procrastination, the state legislature finally acted. On March 6, 2019, the state enacted HB0171. Republican Governor, Mark Gordon, signed it into law. It resulted in the end of the Hemp Extract Registry and changed the CBD industry in Wyoming for the better.

HB0171 made the Wyoming Department of Agriculture the rulemaking authority for the production and regulation of hemp. The bill came around three months after the American President signed the Farm Bill into law. After years of fighting against cannabidiol, the bill passed through with ease. The House voted 56-3 in favor, and the Senate also voted heavily in favor, 26-3.

What the act did was to remove hemp from the Wyoming Controlled Substances Act. Crucially, it also removed CBD. This is something that the Farm Bill did not do, and would frankly have alleviated a lot of confusion if it had.

Therefore, Wyoming residents can freely purchase CBD oil in their state, as long as it comes from hemp, and has less than 0.3% THC. However, please remember that the FDA maintains regulatory authority once hemp-derived CBD products are sold across state lines. If you use any marijuana product or anything with more than 0.3% THC, you are at risk of one of Wyoming’s strict penalties.

Does Wyoming Have an Industrial Hemp Program?

Yes. It is a significant part of HB0171. The Farm Bill permits industrial hemp cultivation throughout the United States. However, each state must submit a plan for approval. Wyoming did so in January 2020 and received good news within a few weeks. The United States Department of Agriculture (USDA) approved the Wyoming hemp regulatory plan. It granted authority to the WDA to regulate the Wyoming hemp industry.

The next step for the WDA was to implement emergency rules, which will remain in place for 120 days. During this period, the WDA aims to go through the standard rule promulgation process. This includes a public comment period and a final rule. At the time, the WDA Director, Doug Miyamoto, said hemp was a new crop with the attached inherent risks.

In the meantime, Wyoming farmers have come together to learn more about hemp. The state certainly has advantageous climate conditions for the crop. Justin Loeffler is part of the GreenTree Ag LLC and believes the short growing season is a huge help. His company planted 11 varieties of hemp in Colorado on 60 acres of land. They selected an area of the state with similar climate conditions to Wyoming. It hopes to learn enough to help farmers combat the challenges they are sure to face.

A considerable majority of the hemp grown in the United States is for the CBD industry. It is potentially an enormous cash crop, and it is no surprise to learn that thousands of farmers want to try. However, there are also plenty of risks attached. Issues like cross-pollination, flooding, and pests can all damage a crop. Also, farmers that produce hemp with more than 0.3% THC will see their plants destroyed.

Final Thoughts on CBD and Cannabis Laws in Wyoming

The prohibition on marijuana in Wyoming has lasted for more than a century. Unfortunately, it doesn’t seem likely to change anytime soon. At present, it is one of 17 states with no MMJ program. With various attempts to bring an MMJ bill to the legislature failing, we fear it will be several years before Wyoming makes a serious effort at permitting cannabis. This is despite the overwhelming majority of state residents saying they support MMJ!

At least Wyoming now allows the sale, possession, and use of CBD. However, this process also took several years, and only came into effect in 2019. Residents can now use hemp-derived CBD with a maximum of 0.3% THC, without a doctor’s prescription. The Wyoming hemp industry will start in earnest this year. It is interesting to see how many farmers try to make the most out of this promising cash crop. Even if it doesn’t make the CBD market, there are a ton of other uses for hemp!

Cannabidiol (CBD), an extract that many use as an anti-anxiety or relaxation tool, comes from the Cannabis sativa plant and cannot be divorced from this original source. Cannabis sativa has many different variations, and not all of these contain significant amounts of CBD. Prior to the gradual ending of cannabis prohibition in many locales, CBD was practically eliminated from the commercial black market to maximize profitability of the psychoactive cannabinoid content of the plants through selective breeding, according to many of the black-market growers I have spoken with throughout the years. The reason CBD is now widely accessible is most assuredly due to the change in social perceptions of this once-outlawed plant and the legalization of this plant in many locales. Without cannabis legalization, CBD would be difficult to acquire—and there would be no testing to ensure that consumers receive the product they are paying for.

In the process of developing recipes, I spent much of my time talking to CBD farmers and exploring their lush farms. I am forever grateful to my friends at Feather Canyon Farms in Del Norte County, California, for introducing me to some of the most impressive plants I’ve ever seen in my life. Beforehand, my experience with these plants had been limited to small indoor grows and the product offerings of our legal cannabis dispensaries.

One of the things I learned from the CBD farmers is that CBD can be an unstable and fleeting trait in cannabis plants. CBD production doesn’t just depend on the genetics of a plant, but the methods of growing, and what is also recognized in grape and wine production as the terroir. New strains of CBD-rich cannabis are being developed for the legal market all the time. I haven’t been able to try them all, but I’ve had the privilege of trying some of the most well-known strains, such as Harlequin, Harle-Tsu, ACDC, Cannatonic, Charlotte’s Web, Sour Tsunami, and a rare crop of Golden Goat, which expressed more than 8% CBD. This list is by no means complete in terms of CBD-rich cannabis strains available.

Hemp, the low-to-no THC variety of Cannabis sativa grown for the oilseed and fiber it produces, can also produce CBD in varying amounts. Both wild hemp and cultivated hemp can produce CBD in their resins. No matter what variety of Cannabis sativa produces CBD, the molecule is always the same.

Farmers, Plants, and Test Results over Brands: How To Select CBD Products

I believe that quality, whole-plant infusions and extractions matter. Epidiolex, the FDA-approved drug, is a whole-plant extract of CBD, purified, standardized, and manufactured for consistency. It’s rare as far as pharmaceuticals go; GW Pharma grows and processes their own cannabis to make therapeutic pharmaceuticals. Whether you are in need of a pharmaceutical treatment or are using CBD as a home remedy or for pleasure, you should be using whole-plant infusions and extractions. The cannabis farmers I spoke with have expressed a similar belief.

I am often asked about which brands of CBD are the best and which products to choose. But the truth is that when it comes to CBD, brands do not matter. Farms and plants matter. Selecting quality CBD-rich cannabis plant products begins with the farm they are grown on. Before you purchase any CBD product, know the farm and farmer. This is an easy task in most of our state-legal cannabis dispensaries, as this information will be readily available and even used as a marketing tool. This information is harder to find if you are purchasing CBD products from the over-the-counter herbal supplement market.

CBD products sold over the counter in the mainstream herbal supplement market do not have the oversight and regulated testing that most of our state-legal dispensary systems have. If you choose to purchase CBD products in the herbal supplement market, you must rely on the information they provide to you in terms of acquisition of plant material and test results. You must also be aware that there is controversy (both legal and scientific) surrounding the purchase of CBD products over the counter through the mainstream herbal supplement marketplace.

Test results matter. The herbal supplement marketplace is largely unregulated and a bit like the Wild West. An exposé in the New York Times in 2013 detailed some very disturbing problems with the herbal supplement marketplace and the fact that consumers often do not receive the products they are paying for. As well, CBD supplement merchants in the over-the-counter herbal supplement market have been cited by the FDA for many violations around the labeling and distribution of their products.

Certainly, I am not saying that all herbal supplement products are bad. Farmers know best. And this oil recipe was given to me by one of the most hardworking and knowledgeable CBD farmers I have met, Mr. Jesse Davis of Feather Canyon Farms in Del Norte County, California.

I experienced many pleasant surprises while sampling this oil at home, and the process of making it was even more surprising. Rich in both CBD and the natural terpenes of the Harle-Tsu CBD-rich cannabis plant, this oil is a gorgeous emerald color with a sublime minty and herbaceous flavor that I have never experienced with a CBD oil previously. This oil was completely non-intoxicating, but it was very pleasant and relaxing.

This oil, processed in MCT oil (fractionated coconut oil) at a low temperature for 24 hours, produced a CBD oil product that has lab tested at 10mg CBD and less than 1 mg

THC per 1ml dose. How low was that temperature? 175°F (80°C)—a temperature much lower than what is typically expected for a complete decarboxylation. What made the difference? The slow processing of this oil over a 24-hour period. Decarboxylation takes place with temperature, time, or in this case, both time and temperature.

I am satisfied that the flavor profile of this oil was only possible due to the careful, low-temperature processing technique that retained the majority of naturally occurring terpenes in the whole cannabis flowers from the CBD-rich Harle-Tsu cannabis strain grown in the mountain region of Del Norte County. Flower quality really does matter when it comes to producing an exquisite CBD oil such as this one.

This makes approximately 10 oz. (296ml) of CBD oil, but you can increase or decrease the amount of oil or flowers depending on the CBD concentration you desire.

10 oz. (296ml) MCT oil or more (otherwise known as liquid fractionated coconut oil)

1 oz. (28g) or more whole CBD-rich, low-or-no- THC cannabis flowers, cured, dried, and chopped

  1. This recipe requires a slow cooker with a low heat setting to process this oil correctly. Add the chopped cannabis to the slow cooker.
  2. Pour the oil over the cannabis, making sure that all the flower material is covered. If you need to add a little extra oil to cover the flowers, you should do so at this time. Cover the slow cooker and set to the low or low cook setting (depending on your model).
  3. Within at least 3 hours, your slow cooker should reach the final processing temperature of about 175°F (80°C). Use a candy thermometer to verify the temperature and adjust if necessary. Stir the oil and plant material at this time and cover the slow cooker once again.
  4. Every few hours, stir the oil and flower material to evenly distribute the infusion throughout the process. Do not stir frequently, as this will allow more of the volatile terpenes to escape into the air. To preserve as many of the volatile constituents as possible, such as terpenes, leave the lid on the pot throughout the entire process. This can be left to process overnight without stirring.
  5. After the 24-hour period is over, cool the oil by unplugging the slow cooker and allowing the materials to remain in the pot and the oil to cool to room temperature a few more hours.
  6. Strain the oil from the plant material through cheesecloth and into a clean glass jar. The oil is now ready to use by itself in measured doses or in any recipe.

Store in a cool, dark, and dry area. Use within 6 months for freshest flavor

How to extract CBD from cannabis

Extracting cannabinoids from cannabis or hemp can be as simple as making cannabutter at home. Carbon dioxide (CO2) extraction method: Carbon dioxide is a versatile gas with a variety of commercial uses, including extracting compounds from plant matter. Through the use of a pressurized chamber, called a closed-loop extractor, CO2 gas is compressed until it becomes a liquid. The liquid is forced over the cannabis material where it strips away cannabinoids like CBD. The entire solution is brought back to temperatures and pressures at which the CO2 reverts to gas and evaporates, leaving behind the CBD extracted out of the cannabis plant material.

Andrew Leising, VP of Strategic Sourcing for Balanced Health Botanicals, elaborated on the process: “CO2 is a scalable and highly versatile form of extraction. There are CO2 extraction units built to process anywhere from 1 to 1,200 pounds of biomass in a single run. With CO2 extraction, you can not only extract cannabinoids on a large scale efficiently, you can extract specific compounds like terpenes.”

Terpenes are the naturally-occurring compounds that infuse cannabis with its signature aromas and flavors as well as potential therapeutic benefits. Full-spectrum CBD products rely on extraction methods that can keep these compounds intact.

Solvent extraction method: The solvent extraction process is similar to using CO2, but it’s notably cheaper and faster. Butane has long been used in cannabis extraction but ethanol and propane are also popular. This method also uses a closed-loop system wherein the liquid butane, propane, or ethanol washes over the cannabis, releasing the CBD, other cannabinoids, and terpenes. The solvent then has to be carefully heated or cooled to separate the solvent from the extracted compounds without damaging them. The main drawback of solvent extraction is that some solvents may extract impurities from the cannabis plant material, which could give the end-product an unpleasant taste.

Both of these extraction methods use highly combustible chemicals and can be dangerous. Only trained professionals in properly equipped labs should attempt any kind of chemical extraction.

How long does CBD extraction take?

The process of CBD extraction is fairly expedient and can take place in a single afternoon. According to Leising, it takes about three to four hours to process up to 1,200 pounds of cannabis.

What happens after CBD oil extraction?

After CBD oil is extracted from hemp or cannabis, the process of winterization begins. This process removes the impurities and unwanted elements that made it through the extraction process, such as fats, lipids, and waxes. In essence, winterization transforms crude oil into purified oil. The process gets its name from a step which involves mixing the extracted oil with ethanol and freezing the solution. The impurities and undesirable compounds solidify and fall out of the solution, which is then passed through a filter, separating wax, lipids, and fats from the oil. The final step involves removing the ethanol from the solution.

CBD may go through further refinement after winterization to create the purest possible CBD product. The additional refinement phase is known as short-path distillation. The process is similar to winterization, but it involves using reduced pressure to allow lower-than-normal boiling temperatures. The solution is heated just enough for the impurities to boil off and travel a short path out of the system, leaving pure CBD oil to distill into the collection chamber.

Which CBD extraction method is best?

Many cannabis experts agree that the CO2 method is best for producing premium oil that stays potent longer because the hemp or cannabis compounds remain stable during this type of extraction. Full-spectrum CBD oil, prized for its potency and purity, is made via CO2 extraction. Other methods may destabilize the compounds, potentially creating lower-quality CBD oil with a shorter shelf life.

Leising agrees that the CO2 method is superior. As he shared, “CO2 is generally preferred for the extraction of cannabinoids that are meant for ingestion or further refinement. Due to the nature of the extraction process, you can be assured that your extracted oil will be free of any residual solvents, microbes, and fungi.”

The same is not true for the solvent method, which often fails to eliminate such impurities.

Can I extract CBD oil at home?

It depends on what extraction method you’re considering. Let’s say you have a thriving indoor cannabis garden and want to consume the cannabis you’ve harvested without having to smoke it all. You can safely make CBD oil at home via a simple infusion and consume a high concentration of cannabinoids without risking life or limb.

What you don’t want to do is attempt to make a CBD extract using inedible solvents or CO2. Leising explained, “You cannot perform CO2 extractions at home. The equipment is cost prohibitive, and if you don’t know how to operate the equipment, it could be extremely dangerous. The equipment runs at extremely high pressures between 2500-4000 PSI and could be very dangerous if the operator is not properly trained.”

Bottom line: don’t risk your life for CBD oil. Visit a reputable dispensary and shop for high-quality, lab-tested products instead.

I received a bottle of Thrive’s CBD oil to try, for the purposes of this review. However all opinions are my own.

There’s a new brand of CBD coming to your virtual shopping baskets. It’s called Thrive – and I was excited to try it and learn more about the brand to find out what’s different about it.

So what’s different?

The first thing I noticed was that it comes in a small matte purple bottle. Even the cardboard box I eased it out of had a silky, upmarket feel – as if it could contain an expensive skin cream or even perfume. A few violet-coloured, branded information cards were tucked into the box it was all delivered in. Thrive has definitely spent a lot of time on their marketing, getting the colours just right – a calming soft violet. Just opening the box feels special, like you’re opening a present.

And then you get why.

Unlike the marketing of many other CBD oil brands, which seem to focus on sports performance or nutrition, Thrive pushes the whole idea of YOU. Taking time out. Calming and slowing down, and focusing on what you need, mentally. Along with an information card there was a card in the box with a list of things to do just for yourself, and also a checklist that you can put on your fridge and tick off the good habits you’ve committed to every day. You know, like taking your CBD oil and having a hot shower. A quiet cup of tea. Those kinds of things.

The product itself contains the same ingredients – CBD (hemp extract), MCT oil and flavour extracts – as other brands I’ve seen. So as well as the personal wellness/’me time’ idea being something new, Thrive have a brand new flavour that I’ve never seen before in CBD-world: Blood Orange. And oh my gosh it’s good. Drop the liquid under your tongue and you immediately get a burst of orange but less refreshing or zesty than you’d expect and a lot more chocolate orange. I’ve been used to standard flavours like lemon and peppermint up until now and this was a refreshing change for me. Thrive also make a peppermint flavour, if you’re interested in that.

As for the CBD, again, it’s THC free so won’t get you high (thanks to a patented cold ethanol extraction process), comes in 500mg strength and their cannabis is organically grown without any harsh pesticides and the oil is lab tested. Pretty standard. The matte coating on the bottle is not only for prettiness – although we’re warned on the box not to leave our oil out in sunlight, I imagine this goes some way in protecting the oil inside from inadvertent sunlight exposure.

It’s downright delicious, they have lots of tips on looking after yourself spiritually and mentally and it comes in a pretty bottle. The CBD oil inside is great quality, THC, organic and lab tested to all the right laws. I guess it’s quite similar to a lot of other brands on the market, but does appeal to those of us who will want to slow down and snuggle up with a good book once in a while. Top marks for such appealing and clever marketing – lots of wellness tips over on their Instagram too – and for developing a brand new flavour that I’m sure will appeal to many people.

Under the 2018 Farm Bill, the Food and Drug Administration (FDA) has the power to regulate CBD product labeling, including therapeutic claims and the use of CBD as a food additive. The FDA has already maintained that even hemp-derived CBD may not be added to food and beverages, or marketed as a dietary supplement. And though the organization has begun to re-evaluate some of these stances on legal CBD products, the FDA has not revised its regulations. The agency also has been strict in its stance against any labeling that could be perceived as a medical claim about CBD.

In addition to federal regulation of CBD, the Farm Bill also gave states the option to regulate and prohibit the cultivation and commerce of CBD. States may also regulate CBD in food, beverages, dietary supplements, and cosmetic products independently, even before the FDA finalizes its policies.

Idaho CBD laws

In 2015, the Idaho legislature passed SB 1146, which would have legalized the use of CBD oil with no more than 0.3% THC for uncontrolled epilepsy. The bill also proposed legal protection for parents to obtain CBD oil out of state. The bill was vetoed by Republican Gov. Governor C.L. “Butch” Otter, who instead issued an executive order for an Expanded Access Program to allow children with intractable epilepsy to take the FDA-approved Epidiolex. Because Epidiolex was approved by the FDA in 2018, it is now legal to prescribe in Idaho.

According to Idaho code S37-2701(t), CBD and CBD products are legal only if they contain zero THC and are derived from one of five parts of the cannabis plant:

  • Mature stalks of the plant
  • Fiber produced from the stalks
  • Oil or cake made from the seeds of the achene of the plant
  • Any other compound, salt, derivative, mixture, or preparation of the mature stalks
  • A sterilized seed of the plant incapable of germination

If a CBD product doesn’t meet these requirements, state law considers it a controlled substance. Hemp also is considered marijuana under Idaho code S37-2701(t), which makes hemp extract a controlled substance if it doesn’t meet the above requirements.

As of 2019, Idaho has yet to enact new CBD legislation in response to the 2018 Farm Bill. A bill to legalize hemp under the federal 0.3% THC standard, as well as its transportation across state lines, was passed by the House and Senate, but died when the house rejected Senate amendments to the bill.

Licensing requirements for CBD

As the window for legal CBD products is so narrow under Idaho state law, there are currently no state licensing or sale regulations for CBD oil. Permits to sell CBD or operate a storefront that sells CBD oil are under the jurisdiction of cities, which may or may not require lab test results from prospective retailers to prove that their CBD products meet state requirements.

Sales of CBD products that don’t fit legal requirements will be treated as marijuana, and therefore a Schedule 1 substance by Idaho law enforcement. Cultivation, sale or delivery of 1 pound (0.5 kilograms) or more, but less than 5 pounds (11.3 kilograms) of marijuana will receive a minimum prison sentence of one year and a $5,000 fine. The penalty for cultivating or selling between 5 and 25 pounds (2.3 to 11.3 kilograms) of mariuana is a minimum of a three-year prison term and $10,000 fine. Cultivation, sale or delivery of 25 pounds or more of marijuana results in a minimum five-years prison sentence and a maximum fine of $50,000. Maximum prison sentences for sale or delivery of marijuana in Idaho are 15 years, with a maximum fine of $50,000.

Idaho CBD possession limits and penalties

Possession of any CBD product without a legal prescription is charged as possession of marijuana in Idaho. Possession of less than 3 ounces, or 85 grams, of any product the state defines as marijuana will be treated as a misdemeanor, with a maximum one year imprisonment and a $1,000 fine. Possession of more than 3 ounces, or 85 grams, of marijuana results in a maximum five-year prison sentence with a maximum $10,000 fine.

Where to buy CBD in Idaho

Several Idaho cities have CBD retailers and storefronts, most of which claim to sell products that comply with state requirements for legal CBD oils and other products. Unfortunately, tight restrictions and lack of regulations make it difficult for consumers to know for sure whether what they have purchased CBD with zero THC as required by law. CBD oil also is available from online retailers, but it is even less likely to be in line with Idaho state legal requirements.

How to read CBD labels and packaging

The 2018 Farm Bill shifted oversight from the U.S. Department of Justice (DOJ) to the U.S. Food and Drug Administration (FDA). As the FDA slowly begins to make new regulations for CBD products, the market remains largely buyer beware. Still, the agency warns that regulations in flux still require companies to make legitimate claims on their labels.

Most reputable CBD producers typically include the following information on their CBD product labels:

  • Amount of active CBD per serving.
  • Supplement Fact panel, including other ingredients.
  • Net weight.
  • Manufacturer or distributor name.
  • Suggested use.
  • Full spectrum, broad-spectrum, or isolate.
  • Batch or date code.

As a CBD enthusiast and product reviewer, I receive a lot of questions about products, and Charlotte’s Web is one up-and-coming brand in the CBD space that I get asked about often.

I’m here to give you my honest review on Charlotte’s Web, including the pros and cons of the company (through my eyes), as well as some insights into three Charlotte’s Web products that I’ve tried myself.

Founded by the 7 Stanley Brothers in 2012, Charlotte’s Web produces a number of commercially available CBD products, from gummies to tinctures to pet treats. How Much CBD am I Consuming from Each Vape Puff?

If you have ever been outside at any point in the last several years, you will likely have noticed people vaping as they walk. Their existence is noticeable due to the thick, billowing clouds of vapor that they leave in their wake, like a Native American sending smoke signals to signal their presence.

Used as an alternative to regular smoking, both with tobacco and with marijuana products, vaping allows users to enjoy their smoking product of choice without the unpleasantness of combustion and with the option of adding a unique flavor to each puff.

But how effective is it? Are vapers getting the same amount of CBD they would with regular joints? Just how much CBD are they getting from each vape puff?

What is the Process Behind Each Puff?

To best understand how much CBD is in each puff from vaporization, we need to understand how a vaporizer works.

A vaporizer is a remarkably simple looking piece of machinery, but it is actually a sophisticated piece of scientific hardware, crafted with high tech parts and precision instruments.

To start with, CBD or THC oil is stored in a replaceable or rechargeable tank at the end of the vape pen. This is filled with CBD or THC oil that has been “thinned out” with thinning agents for the purposes of reducing the oil’s viscosity.

When activated, this is then vaporized in a vaporizing chamber in the center of the pen. What happens is that the oil is subjected to intense heat, but still not to the point of combustion. Vaporization means that it is heated to the point where it becomes a gas rather than a liquid.

This vaporous mix of CBD or THC and oil is then inhaled through the breathing nozzle, allowing you to get your preferred cannabinoid without the detriments of smoke or tar.

This vaporization process has existed since the 1960s, but was only made popular in the last 15 years since its application in China – 60% of Chinese men are regular smokers of vape pens, though in their case it is tobacco they are taking and not CBD.

The use of vape pens for marijuana has been a rising tide of popularity, leading to it being one of the most common methods of marijuana consumption in the USA.

Not only is it easier and without the irritants of Marijuana, but there are even studies , such as one by Konstantinos E. Farsalinos and Riccardo Polosa for the Journal of Therapeutic Advances in Drug Safety, that show it is far healthier than smoking regularly, as well as simply easier and more enjoyable.

However, what about its effectiveness? Is vaping a useful alternative to smoking regular joints or taking CBD or THC oil directly, or is it just a fad?

What Do the Scientists Say?

To understand how much CBD you are getting from each puff of a vape pen requires two things: An analysis of how much CBD is within each actual puff from a vape, and then an analysis on how much CBD is able to be utilized by your body when compared to other methods of CBD imbibing.

The content of each CBD puff is pretty easy to determine, because that is actually one of the major benefits of using a vape pen – whatever you vaporize, you are getting pretty much all of it.

When you smoke a joint with marijuana in it, you are combusting plant matter that not only causes a great deal of burnt plant matter and other detritus to enter your lungs, it also potentially burns and damages the cannabinoids, forcing you to lose some of the cannabinoids and terpenes within the bud to the fire.

With vaporizers, however, this is not the case. When you vape, all of the CBD within the oil is vaporized, allowing all of it to enter into your lungs and be used by the body. This means that knowing how much CBD is within each puff only requires you to look at a packet and do some simple math.

Most of the time, CBD oil meant for vaporizers comes with an exact amount of CBD in the entire cylinder, as well as how many breaths it should take to get through it all.

Your vaporizer will also, most likely, come with a guide on how much and how long you should inhale for.

Combining these two pieces of information allows you to learn just exactly how much CBD you’re consuming per breath. For example, if it takes 100 puffs from your vape pen to get through a 100mg cylinder of CBD oil, you are getting exactly 1 mg of CBD per toke.

This is easy when your vape pen only allows you to take a specific quantity of vape oil per breath – for the more advanced ones that let you breathe in as much as you want, a little more guesswork is involved.

You can test it yourself by making sure to take the same length and intensity of toke per puff, and then see how many it takes to get to the end. Divide that number by the CBD content of your CBD oil and you will arrive at the amount of CBD oil per puff.

Working it out more specifically from that is extremely difficult without knowing exactly the make and type of the vape pen, as well as the CBD content of the CBD oil. Next, we need to understand how much CBD is able to be taken in by the body per puff.

A study by the Journal of Clinical Pharmacology and Therapeutics by Abrams et al. found that, during a pilot study to test vaporization as a smokeless method of cannabis delivery, that vape pens were far more efficient at getting the CBD into the body.

By spacing out the intensity of cannabinoids over a 6 day period with regular, measured intakes of vape oil per subject, the researchers were able to observe the effect each puff had on the subjects.

By testing their THC level (in essence, how high they got), researchers were able to determine that essentially the entirety of the THC content administered to each subject was observable in their body.

This means that there was no waste of cannabinoids, something you certainly would not see when using regular cannabis buds due to the loss induced by combustion.

However, there is something to consider; what about any risks associated with vape pens?

Are There Any Risks With Using a Vape Pen?

Vape pens are famously extremely safe when compared to using regular cannabis, but it is still important to remember that there are still possible risks associated with everything that we do.

Though it would appear that your intake of CBD oil is almost entirely pure with each puff, there exists the issue of what the CBD oil is actually made of.

As CBD oil is, as the name states, an oil, when you vaporize it you are not only breathing in the desired cannabinoids, but also the oil as well.

As is likely obvious, our bodies were not designed to breath in vaporized fat particles. This can lead to issues such as Lipoid Pneumonia, a condition wherein the fat molecules of the CBD oil can become trapped within the bronchial tubing of the lungs and lead to respiratory distress and other issues.

Additionally, there is some risk associated with using certain thinning agents that manufacturers use to thin out their CBD oil.

In the case of most manufacturers, they use an artificial thinning agent called Propylene Glycol. Propylene Glycol allows the usually viscous CBD oil to become thinner and more easily vaporized.

However, Propylene Glycol has been demonstrated to break down into carcinogenic compounds within the lungs and bloodstream, leading to an increased risk of developing various types of cancers.

While the risk of eventually developing cancer is actually quite low and, even if it did happen, quite far in the future, it is still an unnecessary risk that you take on by using CBD oil that contains Propylene Glycol.

Is Vaping Worth it?

CBD oil intake through a vape pen isn’t all rainbows and sunshine – there are real risks associated with using it, leading to lung health depreciation and overall increased risks of cancers.

However, it is important to remember that these health risks also exist in other forms of cannabis intake, and indeed exist in a myriad of other daily things we do that we take for granted.

Though there are some health risks that you need to accept, it is absolutely true that using a CBD vape pen allows you to get near enough 100% of the CBD per puff, allowing for a greatly increased quantity of CBD per puff.

Yes, there are risks, but there are risks with everything – are you going to let a few potential harmful factors stop you from enjoying your life and medicating yourself with CBD?

Just remember to use it in moderation; most of the problems exist through long-term, excessive use. Use CBD vape pens intelligently, and you’ll be fine.

CBD — perhaps you’ve heard of it? JK, you’ve definitely heard of it. You probably can’t go anywhere these days without seeing cannabidiol — commonly called CBD — products all over the shelves.

How’d it suddenly get so popular? Well, it’s been reported to have a ton of health and wellness benefits (anxiety relief and better sleep, anyone?). CBD products are cannabis-based, but because they contain little to no THC, they don’t get you high.

If you’re new to CBD, understanding the available products and their dosages can be overwhelming. You may have no idea where to start, what to buy, or how to find your ideal dose of CBD.

Don’t worry — we’ve got you covered! Here’s everything you need to know about taking CBD for the first time.

There are lots of ways you can get CBD into your system, so the first thing you’ll need to decide is how you’ll consume it.

Smoking

Inhalation is the quickest way to get CBD into your bloodstream. If your state has legalized cannabis or has CBD-only dispensaries, you may be able to find CBD flower or “bud” with little to no THC.

Vaping

Creams, lotions, bath bombs, and lube

Yep, you read that right — lube! Topical CBD refers to creams, ointments, and lotions. These may be a good choice for localized pain and inflammation, while transdermal patches may deliver more of a sustained, long-term release.

Bath bombs are trending right now, with plenty of happy bathers claiming that soaking in a tub infused with CBD kick-starts a deep, full-body relaxation. And there are even CBD lubes that may help ease pain and get you in the mood.

Here’s the most important rule when it comes to cannabis: Start low and go slow.

If you’re smoking or vaping CBD, it’s hard to measure your intake in milligrams. But the nice thing about inhalation is that you get pretty instantaneous feedback. If a couple puffs on a CBD vape leaves you feeling relaxed but not too relaxed, that’s probably your happy spot.

Everyone responds to CBD differently. “There’s no such thing as a standard dose of CBD, given that it’s being used… by many people for many different conditions,” says Martin A. Lee, founder of Project CBD.

The different varieties of CBD may also require different dosages. For instance, you may need to take more of a CBD-only isolate compared to a full-spectrum product. If your stuff is CBD-only, Lee recommends 25 milligrams to start. You can always go up or down from there.

If you’re lucky enough to live somewhere with full cannabis access, you can get your feet wet with a lower dose of a full-spectrum CBD. Try 5 milligrams and titrate up (that is, adjust) by 5 more milligrams every couple of days.

Here’s a quickie suggestion guide for the two different types of CBD you may be taking — but remember that everyone is different.

Find the right dosage of CBD isolate

Note: The below dosages are general guidelines for first-time use. You should consult with your healthcare provider before starting a CBD regimen to determine the appropriate dosage for your specific needs.

Day 1: 25 mg

Day 2: Reduce to 10 mg if yesterday’s effects were too strong; otherwise, stay with 25 mg.

Day 3: Same as Day 2

Day 4: Increase to anywhere between 35 and 50 mg if you haven’t yet reached your desired effect.

Day 5: Reduce to 25 mg if a higher dose is too strong; otherwise, stay in the range of 35 to 50 mg for the next few days.

Increase your dose every few days and continue observing the effects. Many adults report finding their sweet spot in the range of 25 to 75 mg of a CBD-only product.

Dosages for full-spectrum CBD

Day 1: 5 mg

Day 2: 5 mg

Day 3: 10 mg (if you haven’t yet reached your desired effect)

Day 4: 10 mg

Day 5: 15 mg (if you haven’t yet reached your desired effect)

Day 6: 15 mg

Day 7: 20 mg (if you haven’t yet reached your desired effect)

Day 8: 20 mg

Day 9: 25 mg (if you haven’t yet reached your desired effect)

Continue increasing your dose until you get the maximum benefit. If you notice any unwanted response to CBD (such as dizziness), reduce your intake.

What you’re shooting for is a minimum effective dose — the sweet spot on the bell curve where you’re taking the most helpful quantity without overdoing it or breaking the bank. (Seriously, have you checked the price tags on high quality CBD products lately?)

It takes a little trial and error to find your ideal dose. But the good news is that most people tolerate CBD well, even in large quantities. Side effects of CBD, if any, tend to be diarrhea, appetite changes, and too much sedation (i.e., the inspiration for those very exaggerated PSAs from middle school).

If your anxiety quiets down, you’re sleeping better, or you’re experiencing less pain, that’s a win!

The time it takes for CBD to work varies based on how you consume it. It could range from a few moments (with vaping/smoking) to several weeks (like when you’re slowly increasing your CBD oil dose for therapeutic effects).

CBD isn’t psychoactive, so you won’t feel stoned. But some people report getting a fairly quick response where stress melts away and their mood is ever-so-slightly lifted.

If you’re taking CBD for therapeutic effects (like for sleep, anxiety, or inflammation), you’ll probably have to take it for a longer time before reaping all the benefits.

In terms of rigorously researched uses, CBD for epilepsy is the blockbuster here. In 2018, the FDA approved Epidiolex to treat two rare seizure disorders, Dravet syndrome and Lennox-Gastaut syndrome.

But even without clinical approval, people are using CBD to address a wide variety of conditions. Lee tells us that an extensive survey of CBD users showed anxiety, depression, and pain as the top-reported uses. Some people are also using CBD alongside conventional cancer treatments, he says.

Here’s what some of the research says about potential uses:

  • Anxiety: A study from 2019 found that 79 percent of people with anxiety showed improvement when taking 25 to 75 milligrams of CBD daily.
  • Insomnia: More research is needed, but a 2017 review of existing studies found that CBD “may have therapeutic potential for the treatment of insomnia.”
  • Depression: A 2010 study on mice found that CBD could have antidepressant effects. These results haven’t yet been fully replicated in people, but nevertheless, plenty of people report symptom relief.
  • Pain and inflammation: A 2017 study on rats found that CBD may be effective in reducing pain. Once again, human studies still need to be done on this.
  • PTSD and nightmares:A small 2019 study found that 10 out of 11 participants with PTSD found some relief with CBD. Some also reported relief from nightmares associated with PTSD.
  • Nausea: THC is better known for helping with nausea, such as from chemotherapy. But CBD may have some benefits too. Many people report an improvement in nausea symptoms with CBD, and a 2010 study seems to back that up
